Moshtix - Privacy Policy

moshtix primary role is to provide event publishing, registration, ticketing
and related software and services to Australian, US, UK and other International
users of moshtix and the moshtix platform.
Our policy for consumer privacy and data protection is based on fair
information principles recognised internationally (such as the "Safe
Harbour Privacy Principles" that moshtix has agreed to follow) and
in Australia (the National Privacy Principles found in Australia's Privacy
Act). We are committed to complying with Australia's Privacy Act.
We value trusted relationships with consumers by delivering great services
and safeguarding personal information of anyone that interacts with moshtix
and the moshtix platform.
Data Protection Policies:
We are committed to taking all reasonable steps to ensure that our
customers are:
Updated with any changes to our privacy statement, that it is easy to
find, and is written in clear and understandable language. Our privacy
statements describe the extent and primary purposes for all collection
and use of personal information.
Provided with choice and control over their information and how it is
used. We endeavour to provide easy-to-use information and update processes
for consumers to tell us how they want their information to be used or
shared.
Able to review their information and have ways to change information
about them quickly and easily. We endeavour to provide an easy to use
process for update and correction of personal information. We will only
refuse a request for access to personal information when permitted by
law and, in the unlikely event that this occurs, will give an email explanation
for our decision.
Provided security for their data through strong measures incorporated
in a security program designed to protect consumer information from unauthorized
access, use, or disclosure.
Service providers:
moshtix engages third parties to provide services to us, which may include
collecting or processing personal information on our behalf. Examples
of such third parties include call centre operators, software contractors
and email/sms broadcast providers. We insist that any such third parties
abide by Australian and US privacy law.
WHAT SORT OF PERSONAL INFORMATION DOES moshtix HOLD?
New EVENT ORGANISER account registrations
If you have registered a moshtix account with us, we will hold your contact
and billing details. Those details are primarily used to send you information
about the moshtix platform, any upgrades that become available, new developments,
upgrades and forthcoming features and to charge you for service fees.
Technical Support
If you email our support line, or seek online support from us, we will
hold your contact details and, if you have paid for customer service,
credit card or other payment details. We keep a record of the problem
that you report and recommendations and steps we have taken.
Online Ticket Bookings and Registrations
If you have booked or registered for events that are listed by an EVENT
ORGANISER using moshtix and the moshtix platform, we keep a record of
your booking data to report to the EVENT ORGANISER. This booking data
may be used in future event marketing campaigns by the EVENT ORGANISER
and moshtix. We will also keep a record of your billing information to
allow you to make quick purchases by simply using an email address and
password to login to your moshtix account.
You can opt-out of receiving email campaigns during the ticket
purchase or registration process by logging into your moshfile at www.moshtix.com.au
and unchecking the EVENT ORGANISER radio button on the MAILING LISTS tab.
You can opt-out of receiving your customised moshguide by logging
into your moshfile at www.moshtix.com.au and under the MOSHGUIDE tab setting
your guide to "Do not send".
You can opt-in to receive SMS campaigns during the ticket purchase
or registration process by checking the 'I prefer to be contacted by:
SMS' check box.
Moshcard Registrations
If you have booked through a moshtix Retail Associate and then registered
your moshtix moshcard, where you have opted-in to receive updates by email
or SMS, this registration data may be used in future event marketing campaigns
by the EVENT ORGANISER for which the moshcard was allocated tickets, by
the moshtix Retail Associate through which you purchased your tickets
to update you on store based information and by moshtix. You can optionally
opt-in to receiving these campaigns during the moshcard registration
process.
All moshcard registrations are managed online, you can use link which
is at the bottom of every email to log in to your moshfile at www.moshtix.com.au
- and this link is on the bottom of all emails sent from the moshtix platform.
All SMS messages are sent with an opportunity to reply and unsubscribe
from future broadcasts in your expressed category of interest.
Newsletter and other subscriptions
If you have subscribed to moshguide or one of our electronic newsletters,
SMS broadcasts or other information services, we will hold your contact
details. Those details are used to communicate directly with you on the
topics you have expressed an interest in. All subscriptions are managed
online, and you can use link which is at the bottom of every email to
log in to your moshfile at www.moshtix.com.au and this is at the bottom
of every email sent from the moshtix platform. All SMS messages are sent
with an opportunity to reply and unsubscribe from future broadcasts in
your expressed category of interest.
Special promotions and competitions
You may have given us your contact details or other personal information
in connection with a promotion or a competition. We retain this information
so that we may contact you about the latest offers and promotions, sales
and events information. All subscriptions are managed online, and you
can use link which is at the bottom of every email to log in to your moshfile
at www.moshtix.com.au and this is at the bottom of every email sent from
the moshtix platform.
Anti piracy
Software piracy seriously impacts the software industry worldwide. From
time to time moshtix receives reports of suspected piracy and investigates
those reports. Software piracy may be a criminal offence, and sometimes
an investigation is undertaken. Whilst most reports concern piracy by
businesses, some personal information may be collected.

Policy
Welcome to a moshtix powered event.
Our mission is to make your browsing and purchasing experience easy,
fast and fair, so you can get your tickets or make registrations as quickly
and as fast as possible.
The following Terms and Conditions of Use and Purchase Policy has been
created to ensure you are happy with your ticket purchase and that you
fully understand the purchase process with the EVENT ORGANISER who uses
moshtix, the moshtix platform, moshtix powered partner websites and moshtix
retail store associates to promote their events, sell tickets, make registrations
and bookings.
Moshtix Terms and Conditions of Use
The following are the terms that govern use of the moshtix booking system
and web pages created by the EVENT ORGANISER using moshtix ("moshtix
platform"). By using or visiting the moshtix platform, you expressly
agree to be bound by these Terms and to follow these Terms and all applicable
laws and regulations governing the moshtix platform. Moshtix Pty Ltd,
moshtix.com, moshtix.com.au and moshtix.co.uk (collectively "Moshtix")
reserve the right to change these Terms at any time, effective immediately
upon posting on the moshtix platform. To ensure you are aware of the latest
Purchase Policy and Terms and Conditions of Use, please check this page
of the moshtix platform periodically which is avaialble from every event
page on the moshtix platform. The latest date of issue will be posted
at the top of this page. If you violate these Terms of Use, moshtix may
cancel your ticket orders, terminate your use of moshtix and the moshtix
platform, prevent you from making all future bookings using the moshtix
platform, and/or take legal action against you.
How moshtix works with the EVENT ORGANISER
moshtix provides the moshtix platform and associated software to EVENT
ORGANISERS so that they may list event details, set ticket inventory,
sells tickets, take registrations and manage other event functions using
the moshtix platform. Moshtix provides access to certain parts of the
moshtix platform to the general public so that they may transact and interact
with the EVENT ORGANISER.
Permitted Use of the moshtix platform
You agree that you are only authorized to visit, view and to retain
a copy of pages of moshtix platform for your own personal use, and that
you shall not duplicate, download, publish, modify or otherwise distribute
the material on this Site for any purpose other than to review an event
and it's promotional information, for personal use, or to purchase tickets
for your personal use, unless otherwise specifically authorized by Moshtix
to do so.
The content and software on this Site is the property of Moshtix and
is protected by Australian and international copyright laws. We post a
legal notice and various credits on the moshtix platform, which may not
be amended or removed. Please do not remove this notice or these credits,
or any additional information contained along with the notices and credits.
Links and Search Results on the moshtix platform
The moshtix platform may include links posted by the EVENT ORGANISER
or automatically produce search results that reference or link to third
party sites throughout the World Wide Web. Moshtix has no control over
these web sites or the content contained within them. Moshtix cannot guarantee,
represent or warrant that the content contained in third party websites
is accurate, legal and/or inoffensive.
Moshtix does not endorse the content of any third party site, nor do
we warrant that they will not contain viruses or otherwise impact your
computer in a harmful or damaging way. By using the moshtix platform to
search for or link to another site, you agree and understand that you
may not make any claim against Moshtix for any damages or losses, whatsoever,
resulting from your use of the moshtix platform to obtain search results
or to link to another site. If you have a problem with a link from the
moshtix platform, please notify us at contact@moshtix.com.au and we will
investigate the problem you describe in your email and take actions that
we deem are appropriate in our sole discretion.
Unauthorized Use of the moshtix platform
Illegal and/or unauthorized uses of the moshtix platform, whether for
unauthorized ticket sales, unauthorized framing of or linking to the moshtix
platform will be investigated and appropriate legal action will be taken.
Violation of these Terms and Conditions
You understand and agree that in Moshtix's and/or the EVENT ORGANISERS
sole discretion, and without prior notice, Moshtix and/or the EVENT ORGANISERS
may terminate your access to the moshtix platform, cancel your ticket
order or exercise any other remedy available and remove any unauthorized
User Content, if Moshtix believes that the User Content you provided has
violated or is inconsistent with these Terms of Use or has violated the
rights of moshtix, any other User or the law.
You agree that monetary damages may not provide a sufficient remedy to
Moshtix for violations of these terms and conditions and you consent to
injunctive or other equitable relief for such violations. Moshtix may
release user information about you if required by law or subpoena, or
if the information is necessary or appropriate to release to address an
unlawful or harmful activity. Moshtix is not required to provide any refund
to you if you are terminated as a User because you have violated these
Terms of Use.
Moshtix Copyright Policy
We will terminate the privileges of any user who uses this moshtix platform
to unlawfully transmit copyrighted material without a license, express
consent, valid defense or fair use exemption to do so. In particular,
users who submit Content to this moshtix platform, whether articles, images,
stories, software or other copyrightable material must ensure that the
Content they upload does not infringe the copyrights or other rights of
third parties (such as privacy or publicity rights).
After proper notification by the copyright holder or it agent to us,
and confirmation through court order or admission by the user that they
have used this moshtix platform as an instrument of unlawful infringement,
we will terminate the infringing users' rights to use and/or access to
this moshtix platform. We may, also in our sole discretion, decide to
terminate a user's rights to use or access to the moshtix platform prior
to that time if we believe that the alleged infringement has occurred.
Disclaimers
Moshtix does not promise that the moshtix platform will be error-free,
uninterrupted, nor that it will provide specific results from use of the
moshtix platform or any Content, search or link on it. The moshtix platform
and its Content are delivered on an "as-is" and "as-available"
basis. Moshtix can not ensure that files you download from the moshtix
platform will be free of viruses or contamination or destructive features.
Moshtix disclaims all warranties, express or implied, including also any
implied warranties of merchantability and fitness for a particular purpose.
Moshtix will not be liable for any damages of any kind arising from the
use of this moshtix platform, including without limitation, direct, indirect,
incidental, and punitive and consequential damages. Moshtix makes no guarantee
of any specific result from use of this moshtix platform or use of the
Moshtix service.
Moshtix disclaims any and all liability for the acts, omissions and conduct
of any third party users, Moshtix users, advertisers and/or sponsors on
the moshtix platform, in connection with the Moshtix service or otherwise
related to your use of the moshtix platform and/or the Moshtix service.
Moshtix is not responsible for the products, services, actions or failure
to act of any venue, performer, promoter or other third party in connection
with or referenced on the moshtix platform. Without limiting the foregoing,
you may report the misconduct of users and/or third party advertisers,
service and/or product providers referenced on or included in the moshtix
platform to Moshtix at customer.service@moshtix.com.au. Moshtix may investigate
the claim and take appropriate action, in its sole discretion.
Purchase Policy
Payment Methods
moshtix processes your credit card depending upon the methods accepted
by the EVENT ORGANISER which may include: Visa, MasterCard, BankCard,
American Express, Diners Club and JCB.
Limits on Tickets purchases Per Customer
When purchasing tickets on moshtix, you are limited to a maximum of
10 tickets for each event unless the EVENT ORGANISER has authorised such
purchases in it's terms and conditions. If you try to circumvent the moshtix
platforms to purchase more than 10 tickets the EVENT ORGANISER may at
its discretion cancel additional bookings. This policy has been designed
to prevent unfair buying practices at popular events and make sure everyone
gets a fair chance of attending the event.
Pricing and Ticket Availability
moshtix sells tickets on behalf of EVENT ORGANISERS which means moshtix
does not determine the ticket prices, booking fees, postage and handling
fees (if posted tickets are an option) or the seating selections.
Tickets inventory is the responsibility of the EVENT ORGANISER. Given
inventory set by the EVENT ORGANISER, Popular events may sell out quickly.
Occasionally, additional tickets may be available in addition to inventory
set by the EVENT ORGANISER using moshtix, however the EVENT ORGANISER
controls this inventory and its availability.
Delivery of Tickets
Through the moshtix platform the EVENT ORGANISER may elect to offer one
or more of the following delivery options for your ticket order. In most
cases (except moshcards purchased through a moshtix Retail Associate store)
unless specified you will be required to present the credit card used
to purchase tickets and a picture identification, these must match each
other and must match the name your placed the booking under.
You can only buy tickets with
your parents or another persons credit card if:
(a) You have both permission to use the credit card and can bring it
to the event or;
(b) You have permission to use the card and the card holder has completed
the moshtix credit card authorisation form - you will need to bring
the form to the event - click
here to view and print (The card holder
must complete this)
OTHERWISE you
will not be let into the event - even with a valid ticket, so please
purchase your tickets through MOSHTIX
OUTLETS for this event or at the event on the day.
By "email / e-ticket" option:
The moshtix platform provides an opportunity for you to provide your
email address and will attempt to deliver your e-ticket by email to
that email address. If you do not receive your e-ticket then please
contact mostix by email ticketsupport@moshtix.com.au
By "at the door" option:
Tickets delivered through "at the door" delivery option are
typically available one hour prior to the event start time at the location
set by the EVENT ORGANISER. You will need to present your credit card
used to purchase tickets and a picture identification. In Australia
moshtix sells tickets for events at licenced venues, and these venues
require a valid drivers license, passport or proof of age to prove you
are over 18 years of age. The names on the credit card and the ID must
match.
By "moshScan" option:
Tickets delivered through "moshScan" delivery option are
typically available one hour prior to the event start time at the location
set by the EVENT ORGANISER. You will be required to swipe the credit
card at the door for online bookings. You MUST bring the credit card
used to purchase tickets and a picture identification. In Australia
moshtix sells tickets for events at licenced venues, and these venues
require a valid drivers license, passport or proof of age to prove you
are over 18 years of age. The names on the credit card and the ID must
match.
By "Post" or "Registered Post" option
Delivery of tickets are the responsibility of the EVENT ORGANISER,
unless moshtix has undertaken to provide this service to the event organiser.
If you have selected delivery through the mail, please allow at least
10 working days after your order is made to receive your tickets from
the EVENT ORGANISER unless the EVENT ORGANISER has provided express
delivery options. If you have not received your tickets within 48 hours
of the event, please contact the EVENT ORGANISER via the phone number
or email address supplied on the EVENT ORGANISER moshtix event page
or contact moshtix at ticketsupport@moshtix.com.au.
Please ensure you supply the correct billing and credit card account
information for a ticket orders as incorrect details will delay processing
and delivery. Moshtix and EVENT ORGANISER do not post to PO Boxes.
Moshcard issued tickets (issued from an authorised moshtix Retail
Associate store)
Your moshcard will be required to swipe for entry typically available
one hour prior to the event start time at the location set by the EVENT
ORGANISER. You MUST bring your moshcard to the event to gain entry.
The moshtix Retail Associate will also issue you with a printed moshtix
receipt, this is NOT your ticket, only the moshcard is valid for entry
to the event.
Quick Purchases
As with other leading Internet merchants such as Amazon.com, Moshtix
securely saves the billing and credit card information you provide during
purchase. If you do not wish to use this information for future quick
purchases please uncheck the check box next to "Save this card to
my profile" during the booking process.
With mobile phone bookings (coming soon) charges will be made to the
credit card stored on your moshfile and it is your responsibility to ensure
these credit card details are accurate and updated.
Do not set your quick purchase
settings or purchase tickets with your parents or another persons credit
card unless you have their permission or have completed a credit card
authorsation form - as you will not be let into the event - even with
a valid ticket.
Credit Card Payments
All purchases are charged to your credit card at the time of purchase,
not at the time of entry to the event.
Cancelled Events
Occasionally, events are cancelled or postponed by the EVENT ORGANISER
due to weather conditions or situations affecting the staff or audience.
When this occurs, the EVENT ORGANISER will make every effort to ensure
you receive a prompt refund and/or exchange if applicable. If an event
is cancelled or postponed, you will be notified by email if you have opted
in to receive email updates, otherwise please review notices posted
on the EVENT ORGANISER's website or contact the EVENT ORGANISER via the
email address supplied on the EVENT ORGANISER's moshtix listing regarding
receiving a refund. If the event was moved or rescheduled, the EVENT ORGANISER
may set refund limitations. Contact the EVENT ORGANISER for exact instructions.
If a refund has been confirmed by moshtix then the following refund method
applies. If you booked online or by phone using a credit card, moshtix
will automatically refund to the credit card used for purchase within
14 days of notifying you that a refund for this event applies. If you
booked in a authorised moshtix retail outlet, please return to the same
outlet you purchased from along with your moshcards and moshtix receipt
to obtain a full refund within 90 days of the event cancellation. You
will be asked to sign for your refund and you may keep your moshcard.
If you purchased the ticket (s) independent of the moshtix platform,
you will need to return the tickets directly to the place where you purchased
the tickets.
Exchanges and Refunds
Before purchasing tickets, carefully review your event and ticket selection.
Policies set forth by EVENT ORGANISER will dictate the issuing of exchanges
or refunds after a ticket has been purchased or for lost, stolen, damaged
or destroyed tickets.
Other terms
EVENT ORGANISERS may reserve the right of:
1. Admission to events, latecomers may not be admitted until a suitable
break.
2. To change/withdraw advertised artists, programs or seating without
notice.
EVENT ORGANISERS may also append the moshtix terms and conditions and
these additional terms are displayed and agreed to by the purchaser
during the booking process.
